    Description

    Mesa Unified School District #4 (“District”) is seeking a qualified and experienced vendor(s) to provide fixed hourly pricing for temporary contract HVAC technical services as needed, according to the terms, conditions, and specifications of this solicitation. This request will supplement the District staff for providing HVAC repair and maintenance to various sites throughout the District.

    There will be no public opening of the quotations received for this solicitation. Results of this solicitation will be available upon request after an award is made.

    Background

    Mesa Unified School District is the largest school district in Arizona.  The District is located primarily in Mesa, Arizona and is comprised of approximately 200 square miles. The District maintains over 80 educational facilities within the District as well as approximately 12 administrative facilities. These include 6 high schools, 9 junior high schools, 50 elementary schools, 5 success schools, and 12 choice schools.

    This quote is intended to be a limited term agreement for services estimated at $60,000 per year. There is no expressed or guaranteed quantity and usage shall be determined solely by District need.

    This contract will not be renewed at the end of this contract term.

    Evaluation Criteria

    • Requirements

      Mesa Public Schools HVAC Shop requests assistance with repairing their commercial/residential HVAC equipment in the district.

      Firms shall have been in the commercial HVAC business in Arizona for a minimum of five (5) years to be considered for award.

      We are requesting experienced Technicians only to provide repair services on an hourly basis as assigned by the District.

      Our expectation is to work with the same Technician during the term of the contract.

      Technician Level II shall have fifteen (15) years minimum experience with commercial HVAC equipment. In addition, Technician Level II shall have knowledge and experience working on Direct Expansion Multi-Zone Units, Variable Air Volume Units, Chiller Plants, and various Energy Management Control systems.

      Staffing for this contract will be determined based on the workload and staff availability during the term of the contract, but may vary.

      The term of the contract shall be from July 1, 2026 - December 31, 2026.

      The District anticipates utilizing one (1) Technician Level II for 40 hours a week, from July 13th through October 9th, 2026. After October 9th, Technician assistance would be minimal or possibly not even needed unless anticipated circumstances change (workload/staff).

      Hours are an estimated amount only and no quantity is implied or guaranteed. 

    • INSTRUCTIONS TO OFFERORS

      1. Pre-Offer Inquiries

      A. Any inquiry related to a Solicitation, including any requests for or inquiries regarding standards referenced in the Solicitation shall be directed solely to the Solicitation Contact Person. The Offeror shall not contact or direct inquiries concerning the Solicitation to any other employee unless the Solicitation specifically identifies a person other than the Solicitation Contact Person as a contact.

      B. Any inquiry that results in changes to the Solicitation shall be answered solely through a written Solicitation Addendum. An Offeror may not rely on verbal responses from the Solicitation Contact Person to inquiries.

       

      2. Offer Preparation

      A. An Electronic Offer shall be submitted on the forms provided in the Solicitation. No Facsimile or Physical Mail (USPS, FEDEX, UPS, etc ) offers will be accepted.

      B. Modifications shall not be permitted after Offers have been opened except as otherwise provided under applicable law.

      C. The Offeror acknowledges that submittal of a proposal is an acceptance of all Terms and Conditions of the Solicitation.

      D. District will not reimburse an Offeror for the cost of responding to a Solicitation.

      E. Prices stated in a Solicitation shall not include applicable state and local taxes. District is exempt from paying federal excise tax and state property taxes. District is not exempt from state and local transaction privilege (sales) taxes. The amount of any applicable transaction privilege or use tax of a political subdivision of the State is not a factor in determining the lowest Offeror.

       

      3. Submission of Offer

      A. Each Offer shall be submitted electronically through OpenGov.

      B. Offer Amendment or Withdrawal. The Offeror may withdraw an Offer any time prior to the Offer Deadline. The Offer may not be amended or withdrawn after the Offer Deadline, except as otherwise provided under applicable law.

       

      4. Additional Offer Information

      A. An Offer submitted after the Offer Deadline shall not be accepted..

      B. In the case of discrepancy between the unit price or rate and the extension of that unit price or rate, the unit price or rate shall govern.

      C. The Offeror shall hold its Offer open for sixty (60) days from the date the solicitation is due. An Offer may be rejected if the District is unable to issue an order within such timeframe.

    • GENERAL REQUIREMENTS

      The Contractor, by placing this bid, represents that a company representative is familiar with local conditions, the type of work to be performed and has evaluated the difficulty of performing the required tasks, and the labor resources required to provide a complete and satisfactory project.

       

      It is mutually understood and agreed, that the successful bidder shall not assign, transfer, convey, sublet or otherwise dispose of the contract or the right, title, or interest therein, or power to execute such contract, to any other person, company or corporation without prior written consent of the District.

       

      The District shall be the sole judge in determining the award, and its decision shall be final.

      Sales tax will not be a consideration in the award of the quote.

      The District reserves the right to reject or accept any quotes.

    • Contractor Responsibilities

      Contractor to provide the following:

      • Qualified commercial experienced HVAC Technician for 40 hours a week

      • Workdays shall be Monday through Friday for regular working hours of 6:00 am to 2:30 pm, including a 30-minute lunch period

      • Technician must not be pulled off to work outside of district or any other job

      • Company service truck with ladders

      • All required HVAC service tools

      • Technician to provide a weekly time sheet to Supervisor every Friday

      • Technician must report back to the HVAC Office personnel (Craig Lutes, Dale Liversedge, or Tim Chavez) at the end of each shift

      • Contractor must provide a Bi-monthly invoice in a timely manner. All invoices must be submitted no later than January 31st, 2026.

       

       

    • District Responsibilities

      Mesa Public Schools to provide the following:

      • All needed parts and supplies, including refrigerant

      • Daily direction and assistance to get the job done

       

    • CONTRACTOR GUIDELINES, REQUIREMENTS AND RESPONSIBILITIES

      The following guidelines and contractor responsibilities pertain to Contractors, subcontractors and their employees:

       

       

    • WORKING CONDITIONS

      All labor provided under this contract shall conform to the latest and best practices of the industry in each case.

      The Contractor shall comply with all state, county or local laws, ordinances, rules or regulations relating to the performance of his work.

      The contractor shall protect all equipment from damage and shall protect the District's property from damage or loss arising in connection with this contract. The contractor shall make good any such damage, injury or loss caused by their operations, or those of their employees, to the satisfaction of the District.

      The contractor shall confine their equipment, storage of tools, and the operations of their employees to the limits as indicated by the Project Manager.

      Any damage incurred to existing structures, installations, or to adjacent Home Owners Property by the Contractor will be replaced and repaired to original condition at the Contractor's expense to the approval of the District or their representative.

    • Submittals

    • LICENSES/PERMITS

      The bidder shall comply with all Arizona Statutes, and must hold a current Arizona Commercial Contractor's license.

      The bidder shall comply with all codes, (local, state, county, etc.,) and shall secure and pay all costs of all- necessary permits and licenses. However, the District will reimburse the contractor for any permits required by the City of Mesa.

      The bidder shall also be responsible for the payment of all sales, excise and other taxes levied on all items concerned with the contract.

    • SAFETY

      The Contractor shall provide a safe, clean work site during the term of the agreement.

      The Contractor shall take all necessary precautions for the safety of school district employees and the general public.

      The Contractor shall comply with all applicable provisions of Federal, State, and Municipal Safety Laws.

      Offeror, at its own expense and at all times, shall take all reasonable precautions to protect persons and the District property from damage, loss or injury resulting from the activities of Offeror, its employees, its subcontractors, and/or other persons present. Offeror will comply with all specific job safety requirements promulgated by any governmental authority, including without limitation, the requirements of the Occupational Safety Health Act of 1970, National Electrical Code, and National Fire Protection Code.

       

    • INDEMNITY

      The awarded Contractor shall protect, indemnify, and hold harmless Unified School District #4 and its administrators, employees and agents against all claims, damages, losses and expenses arising out of or resulting from the actions of the Contractor or Contractor employees in the execution of the contract.

    • INSURANCE

      The Contractor shall be responsible to the District for the acts and omissions of any and all persons whether directly or indirectly employed by them. They shall maintain such insurance as will protect them and the Mesa Unified School District from claims under Workers Compensation Acts, and from any other claims or damage for personal injury, including death, which may arise from operations under the contract.

      The offeror must provide Statutory Worker's Compensation Insurance or show evidence of comparable insurance by private carrier as well as public liability and property damage coverage with limits no less than $500,000-$1,000,000 bodily injury and $500,000 property damage (or $1,000,000 combined single limit). These documents must be furnished before work begins.

      While performing this project, the offeror guarantees to carry adequate insurance to protect the District in case of accident, fire and theft.

      Workers employed by the Contractor who use their own private vehicles as a service vehicle for their employer, must carry the same insurance requirements listed in this proposal. These documents must be furnished upon request.

       

       

       

    • Insurance Requirement

      A. Insurance: Contractor and subcontractors shall procure and maintain until all of their obligations have been discharged, including any warranty periods are satisfied, insurance against claims for injury to persons or damage to property which may arise from or in connection with the performance of the work by the Contractor, his agents, representatives, employees or subcontractors.

      The insurance requirements herein are minimum requirements and in no way limit the indemnity covenants contained in this quotation. Contractor shall provide coverage with limits of liability not less than those stated below.

      1. Commercial General Liability - Occurrence Form
      Policy shall include bodily injury, property damage and broad form contractual liability coverage.

      General Aggregate $2,000,000

      Products - Completed Operations Aggregate $1,000,000

      Personal and Advertising Injury $1,000,000

      Each Occurrence $1,000,000

      The policy shall be endorsed to include the following additional insured language: "Mesa Unified School District #4 is named as an additional insured with respect to liability arising out of the activities performed by, or on behalf of the Contractor".

      2. Automobile Liability Bodily Injury and Property Damage for any owned, hired, and non-owned vehicles used in the performance of this Contract. Combined Single Limit (CSL) $1,000,000

      The policy shall be endorsed to include the following additional insured language: "Mesa Unified School District #4 is named as an additional insured with respect to liability arising out of the activities performed by, or on behalf of the Contractor, including automobiles owned, leased, hired or borrowed by the Contractor".

      3. Worker's Compensation and Employers' Liability

      4. Property Insurance: Contractor's awarded contracts for construction or expansion of buildings shall obtain and maintain for the duration of the project, course of construction builders risk insurance in the amount of the real property being constructed.

      A. ADDITIONAL INSURANCE REQUIREMENTS: The policies are to contain, or be endorsed to contain, the following provisions:

      1. The Contractor's insurance coverage shall be primary insurance and noncontributory with respect to all other available sources.

      2. Coverage provided by the Contractor shall not be limited to the liability assumed under the indemnification provisions of this Contract.

    • Insurance - SFB Requirement

       

      1. Insurance. Contractor shall procure and maintain until all of its obligations under the Contract have been fully discharged, comprehensive insurance against claims for injury to persons or damage to property which may arise from or in connection with the work performed and material delivered by Contractor or subcontractors. Contractor must have workers compensation insurance unless except by Arizona law. The insurance requirements are minimum requirements and in no way limit the indemnity covenants contained in the Solicitation.
      2. Insurance Coverage. Unless other coverage’s or amounts are specified in the Special Requirements of Solicitation, Contractor shall provide coverage’s with limits of liability not less than the following:
        1. Commercial General Liability – Liability arising out of activities performed by or on behalf of Contractor
          1. General Aggregate $5,000,000
          2. Products – Completed Operations Aggregate $1,000,000
          3. Personal and Advertising Injury $1,000,000
          4. Each Occurrence $2,000,000

        2. The policy shall be endorsed to include the following specific language: "Mesa Unified School District #4 is named as additional insured with respect to liability arising out of the activities performed by, or on behalf of Contractor."
      3. Automobile Liability – Bodily injury and property damage for any owned, hired, and non-owned vehicles used in the performance of the Contract

    • FEDERAL AND STATE REQUIREMENTS (when applicable)

      Fingerprinting Requirements.

      Contractor, including any employee of Contractor, a subcontractor and employee of a subcontractor, who is contracted to supply services on a regular basis (at least five (5) times during a month) at a District school shall at its own expense, obtain a valid fingerprint clearance card in accordance with A.R.S. §41-1758 and present it to District or school prior to commencement of services. An exception to this requirement may be made as authorized in Governing Board policy.

       

      E-Verification.

      Contractor agrees to comply and maintain compliance with FINA, A.R.S. §41-4401, and A.R.S. §23-214, which requires compliance of federal immigration laws by employers, contractors, and subcontractors in accordance with the E-Verify Employee Eligibility Verification Program.

       

      Registered Sex Offender Restriction.

      Contractor agrees that no employee or agent of Contractor or a subcontractor, who has been adjudicated to be a registered sex offender, will perform work on District premises or equipment at any time when District students are, or are reasonably expected to be, present. Contractor further agrees that a violation of this condition shall be considered a material breach and may result in a cancellation of the Contract at District's discretion.

       

      Non-Discrimination.

      Contractor shall comply with all applicable state executive orders and federal and state laws, rules and regulations that protect persons from illegal discrimination on the basis of race, color, religion, national origin, sex, disability, and age.

       

      Offshore Performance of Work Prohibited.

      Due to security and identity protection concerns, direct services under the Contract shall be performed within the borders of the United States. Any services that are described in the specifications or scope of work/services that directly serve the State of Arizona or its clients and may involve access to secure or sensitive data or personal client data or development or modification of software for the State shall be performed within the borders of the United States. Unless specifically stated otherwise in the specifications, this definition does not apply to indirect or “overhead” services, redundant back-up services, or services that are incidental to the performance of the Contract. This provision applies to work performed by subcontractors.

       

      Terrorism Country Divestments.

      In accordance with A.R.S. §35-392, District is prohibited from purchasing a company that is in violation of the Export Administration Act.

    • CONTRACTOR RESPONSIBILITIES

      All work performed on school District property shall be in accordance with the Mesa Unified School District Policies and Procedures.

      Contractor shall be aware of, and abide by the District Dress Policy, and the District Tobacco Free Environment Policy.

      When violations of Policies and Procedures occur, the contractor and/or subcontractor shall be asked to stop all work until any and all violations are resolved to the District’s satisfaction.

      Any contractor, or employee found to be in violation of these policies may be immediately expelled from the site.

      Copies of these policies will be provided to the contractor upon request.

       

    • ALCOHOL, DRUGS AND TOBACCO

      All Schools and Facilities are alcohol, drug and tobacco-free environments. Substances of these types are strictly prohibited on any District Campus and/or Facility.

    • DANGEROUS INSTRUMENTS AND DEADLY WEAPONS

      Dangerous Instruments and Weapons of these types are strictly prohibited on any District Campus and/or Facility:

      “Dangerous Instrument” means a knife, CO2 powered gun, or other instrument, not designated for lethal use but which may be capable of causing physical injury.

      “Deadly Weapon” means anything designated for lethal use including a firearm.

      “Firearm” means any operable or inoperable, loaded or unloaded (a) weapon, including a starter gun, which will or is designed to, or may be converted to expel a projectile by the action of an explosive.

    • WORKER AGE AND DRESS ATTIRE REQUIREMENTS

      All employees of the Contractor and/or Subcontractor(s) must be at least eighteen (18) years of age.

      1. Shirts and Shoes shall be worn at all times.

      2. Shorts – Leg length shall be mid-thigh or longer.

    • LANGUAGE REQUIREMENT

      An English speaking supervisor/foreman shall be on site at all times, during working hours.

      The use of abusive, offensive sexually oriented or vulgar language is prohibited.

    • TERM OF AGREEMENT

      This is an annual request for pricing of temporary HVAC technical services and will not be renewed at the end of this contract term.

      This quote is intended to cover the period of July 1, 2026 through December 31, 2026, which total shall not exceed $100,000 combined, over the course of this contract.

      Anticipated dates of service are indicated in the Scope of Work.

    • BASIS OF AWARD

      A. An Award will be made to the Responsible Offeror or Offerors, whose Offer is determined to be the most advantageous to District based on the requirements of the solicitation and can meet the district's schedule. If an Offeror is awarded a Contract and is unable to meet its contractual obligations, District may cancel the Contract and award a Contract to the next lowest ranked Offeror. The award shall consider price of labor as well as the qualifications of candidates submitted.

      B. A response to the Solicitation is an offer to contract with District based upon the terms, conditions, scope of work/services, and specifications contained in the Solicitation. An Offer does not become a contract unless and until District accepts it. A contract is formed when the District Representative signs the Award document on behalf of District. No work may commence or products be delivered until District has issued a Purchase Order to Contractor.

      C. Sales tax will not be a consideration in the award of the quote.

      D. The District shall be the sole judge in determining the award, and its decision shall be final. The District reserves the right to reject or accept any quotes.

    • MULTIPLE AWARD

      The District reserves the right to make a multiple award to more than one offeror, and may award a single contract or multiple contracts from the Solicitation.

      The award will be limited to the least number of offerors that the District determines is necessary to meet the needs of the District. A multiple Award shall be made only if the District Representative determines that a multiple Award is necessary and is advantageous to District to ensure the availability of services that fully conform to District’s requirements at the time, place and manner needed by District. If District determines that multiple contracts are necessary and advantageous, District will determine the least number of Contractors that are needed and award Contracts to the Offeror(s) who submitted the lowest responsible and responsive proposals.

      The decision to award a single contract, award multiple contracts, or make no award rests solely with District.

       

    • MISCELLANEOUS

      Either party may cancel this contract in whole or in part by providing written notice. The cancellation will take effect 10 business days after the other party receives the notice of cancellation. After the 10th business day, all work will cease and a final invoice will be submitted within 10 business days after the final work day.
