      Identical tie bids: preference shall be given to businesses with drug-free workplace programs. Whenever two or more bids which are equal with respect price, quality, and service are received by the state or by any political subdivision for the procurement of commodities or contractual services, a bid received from a business that certified that it has implemented a drug-free work place program shall be given preference in the award process. Established procedures for processing tie bids will be followed if none of the tied Consultants have a drug-free workplace program. In order to have a drug-free workplace program, a business shall:

      1. Publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the workplace specifying the actions that will be taken against employees for violations of such prohibition.
      2. Inform employees about the dangers of drug abuse in the workplace, the business’s policy of maintaining a drug-free workplace, available drug counseling, rehabilitation providing employee assistance programs, and the penalties that may be imposed upon employees for drug abuse violations.
      3. Give each employee engaged in providing the commodities of contractual services that are under bid a copy of the statement specified in paragraph #A.
      4. In the statement specified in paragraph #1, notify the employees that, as a condition of working on the commodities or contractual services that are under bid, the employee will abide by the terms of the statement and will notify the employer of any conviction of or pleas of guilty or no contest to, and violation of Chapter 893 or of any controlled substance law of the United States or any state, for a violation occurring in the work place no later than five (5) days after such conviction.
      5. Impose a sanction on or require the satisfactory participation in a drug abuse assistance or rehabilitation program if such is available in the employee’s community, by any employee who is so convicted.
      6. Make a good faith effort to continue to maintain a drug-free workplace through implementation of this section.

    Questions & Answers

    Q (Auction sales): What are the total Auction sales per year for the past 3 years? Who is your current Auctioneer and how do they sell your surplus?

    A: The total auction sales for Walton County over the past 3 years are as follows: FY2023 $ 723,005.00 FY2024 $ 1,139,960.00 FY2025 $ 965,652.50 Walton County’s current auctioneer is Jeff Martin Auctioneers, Inc. The County’s surplus assets are currently sold through a combination of live, on-site public auctions with online bidding capabilities, allowing both in-person and remote participation to maximize competitive bidding and returns. However, moving forward, the County intends to transition to an online-only bidding format and will no longer include in-person bidding as an option.


    Q (Asset Clarification): Can the County please clarify which asset types are included in the scope of this contract, specifically, if it includes vehicles and heavy equipment? Additionally, could the County please provide an estimated quantity of assets to be auctioned either annually or over the duration of the contract?

    A: The scope of this contract includes a broad range of surplus assets. It encompasses miscellaneous items, vehicles and equipment, including passenger vehicles, medium and heavy duty trucks, as well as heavy equipment. Additional surplus items may include office equipment, furnishings, and other general property from across the County. Based on historical data the County has averaged 100+ items annually over the past five years. Actual quantities may vary depending upon operational needs and replacement cycles.


    Q (Reserves): How often does the County anticipate setting reserves on items?

    A: Historically, the County has not placed reserves on auction items. However the County would like to retain the ability to implement reserves if warranted based on specific circumstances or conditions.


    Q (Reserves): What type of items does the County typically place reserves on?

    A: The County has not historically placed reserves on any items. The option to apply reserves is intended to remain available on a case by case basis depending on the nature, value or condition of the asset.


    Q (Load-Outs): Can the County please clarify what is required of the vendor for Load-Out of winning items? Again, does this include handling winning bidder phone calls coordinating a time with County personnel for individuals to pick-up items (with the County's help)? Or does the Vendor need to provide personnel at the County's location(s) for load-outs?

    A: The County will assist with load out of items when needed. The Vendor will be responsible for coordinating pickup times directly with the winning bidder and County personnel to ensure proper scheduling and payment verification of purchased items before pickup.


    Q (Public Inspections): Can the County please clarify what is required of the vendor for "Coordinating and managing inspection periods," and "Scheduling and managing public inspection periods?" Does this include handling potential bidder phone calls coordinating a time with County personnel for individuals to inspect items (with the County's help)? Or does the Vendor need to provide personnel at the County's location(s) for the inspections?

    A: Public inspections will be available Tuesday through Thursday 8am-3pm with County personnel present during the inspection period. The vendor will handle the potential bidder phone calls and coordinating a time with County staff for inspection when applicable. Otherwise no on site personnel will be required by the vendor during inspection period.


    Q (Auction Location): To confirm, the County is wishing to keep/store items at their location(s) for auction, correct?

    A: Correct, the County will retain possession of all items until full payment has been received and verified through the auction service provider.


    Q (Dealer's license and auction frequency): Is the vendor required to have a dealer's license in the state of Florida to properly transfer the titles to the winning buyer and out of the County's name? How many times a year were auctions held by the previous vendor for the county?

    A: No, a motor vehicle dealers license is not required solely to conduct an auction, provided the auction is conducted by a properly licensed auctioneer in the State of Florida. Please refer to Florida statute 320.27 for requirements of motor vehicle dealers.


    Q (Insurance): "Professional liability, including errors and omissions coverage if applicable." — What (if any) professional liability coverage is required for this contract?

    A: Professional liability (errors and omissions) coverage is required for this contract if applicable to the proposer’s services. Per the RFP, proposers must carry professional liability insurance with the following minimum requirements: $1,000,000 per occurrence and in the aggregate Coverage for malpractice, negligence, and errors and omissions Policy must include 30 days’ notice of cancellation or restriction However, the requirement is conditional (“if applicable”), meaning: If the proposer’s services include professional or advisory functions (e.g., auction management, financial handling, reporting, or platform services where errors/omissions risk exists), this coverage is expected. If a proposer believes professional liability coverage is not applicable to their business model, they should clearly explain that in their proposal, and the County will evaluate accordingly. Insurance limits may also be modified by the County Risk Manager based on the final scope of services.


    Q (previous vendor rates): What was the commission/buyers premium that the previous vendor was charging? and what were the additional rates, I.E. deposit to bid, online bidders fee, administrative fees?

    A: Previously there was a 0% commission rate. The buyers premium was 10% fee to auctioneer, with a title documentation fee of $40.00, and an additional online bidding fee of 2%


    Q (auction frequency): How many times a year for the past 3 years were auctions held by the previous vendor for the county?

    A: Over the past three years, the previous vendor conducted one auction per year.
