Notice is hereby given that the Town of Eden will accept sealed bids for: Replacement of the Larkin Rd Culvert Over Franklin Gulf Town of Eden, Erie County PIN 5765.08 BID D041323 The Owner is the Town of Eden, and the worksite is in the Town of Eden. The project's limits extend approximately 127’ south and 155’ north of the existing culvert over Franklin Gulf The work includes providing all labor, materials, machinery, tools, equipment, and other means of construction necessary and incidental to the completion of the work shown on the plans and described in these specifications including but not necessarily limited to the following: replacement with a precast concrete box culvert & fill type retaining walls. Heavy stone fill will be placed in the vicinity of the wing walls and along Franklin Gulf. The inadequate pipe rail will be replaced with four-rail box beam bridge rail. Both locations will incorporate full depth pavement reconstruction. The proposed work will be performed while traffic is maintained via an offsite detour. This is a Locally Administered Federal Aid Project and the latest revisions of the NYSDOT Standard Specifications, as posted on the New York State Department of Transportation’s website, must be followed by the successful bidder. There will be no pre-bid meeting held. The DBE goal for this project is: N/A The MBE goal for this project is: 7% The WBE goal for this project is: 11% The SDVOB goal for this project is: 6% The EEO Employment goals for this project are: 7.7% Minority Employment Goal 6.9% Women Employment Goal The use of the NYSDOT approved civil rights reporting software, Equitable Business Opportunities (EBO), is required. Access authorization to EBO can be found at: https://www.dot.ny.gov/portal/page/portal/dotapp/ebo/instructions No residential or geographical restrictions will be in effect for this project. Contract Documents, including Invitation to Bidders, Instructions to Bidders, Wage Rates, Bid Documents, Agreement, Special Notes, Specifications, Contract Drawings, and any Addenda, may be examined, at no expense, at the Town of Eden Clerk’s Office at 2795 East Church St., Eden, New York 14057, the Town of Eden Highway Department at 8197 N. Main St., Eden, New York 14057, or Azar Design Co at 295 Main Street, Suite 200 Buffalo, New York 14203 between the hours of 9:00 am and 3:00 pm Monday through Friday; or are also available electronically by contacting Harrison Sinatra, Project Engineer, Azar Design Co via email at hsinatra@azardzn.com. No questions or inquiries regarding this bid will be accepted within seven (7) business days prior to the bid opening. Contractors that obtain Contract Documents from a source other than the issuing office must notify the issuing office in order to be placed on the official Plan Holder List, to receive Addenda and any other Bid correspondence. Bids received from Contractors other than those on the official Plan Holders List will not be accepted. Addenda will be emailed from Harrison Sinatra, Azar Design Co to Bidders listed on the official Plan Holders List. An emailed response from the Bidder to the Addendum sent by Harrison Sinatra, Azar Design Co will act as proof that the Bidder received the Addendum. In addition to an emailed response, Bidders must acknowledge receipt of all Addenda by signing and dating each Addendum, and the Acknowledgement of Receipt of Addenda, page 33. Failure of any Bidder to receive any such Addendum or interpretation shall not relieve such Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the Contract Documents. Bidders shall promptly notify Harrison Sinatra, Project Engineer, Azar Design Co of any errors, omissions, conflicts, or ambiguity within the Contract Documents within seven (7) business days of bid opening. All bids must include the completed Bid Form, Non-Collusive Bidding and Disbarment Certifications, Lobbying Certifications, & CONR 80LL Bidder’s List. This is a unit price bid as described in the Instructions to Bidders. No bidder may withdraw his/her bid within forty-five (45) calendar days after the actual date of the opening thereof. The bidders will be required to provide an original copy with signatures and two (2) photocopies of their bid package. Each bid must be accompanied by security in an amount not less than five percent (5%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders. Bids to be considered must be received in a sealed envelope clearly labeled, PIN 5765.08 – Replacement of the Larkin Rd Culvert over Franklin Gulf, at Town of Eden Clerk’s Office, 2795 East Church St., Eden, New York 14057, by 2:30 pm, local time, on Thursday, February 12th, 2026, at which time they will be opened and read. Bids received after the above noted time will not be accepted. The Bidder to whom the Contract is awarded will be required to furnish Performance, Payment, and Guarantee Bonds from an acceptable Surety Company for an amount not less than 100% of the accepted bid. The successful Bidder and all subcontractors must have an approved CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instruction for completion online at: https://www.osc.state.ny.us/state-vendors/vendrep/profit-construction-questionnaire-cca-2. Please note if you file online through the OSC site, a responsibility review must still be completed by NYSDOT before work can start. Therefore, once certified on-line, you must notify NYSDOT via email at VendorResponsibility@dot.ny.gov which will initiate the review process. If you file online and do not notify NYSDOT within 3 months, it may be necessary for you to resubmit and recertify, restarting the process. The successful Bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 2, 1968, and published in the Federal Register (41 CFR Part 60-1, 33 F.2 7804). Successful bidders will be required to pay prevailing wage rates on this contract. The Town of Eden reserves the right to consider the bids for forty-five (45) days after receipt before awarding any Contract, and to waive any minor informalities in, and to reject, any and all bids. All bids are subject to final review and approval by the Town of Eden before any award of contract may be made. Receipt of bids by the Town of Eden shall not be construed as authority to bind Town of Eden. The work will begin no later than ten (10) calendar days from Notice to Proceed and ready for final payment on 10/31/2026.
