    Description

    The City of Bradenton is seeking services of a qualified engineering firm to complete a Water Treatment Plant and Drink Water Distribution System Facilities Plan. The Facilities Plan must address the key components of a Florida Department of Environmental Protection (FDEP) sponsored facilities plan and the requirements established by FDEP and Rule 62-552, F.A.C., and others as applicable .

    The Facilities Plan shall span a 20-year planning horizon and include specific documentation and details that address damage, impacts, loss of service, or disruption due to Hurricanes Helene and Milton in addition to the listed elements above.

    Project is being funded through the Supplemental Agreement - Helene and Milton (SAHM), Consultants must adhere to the SAHM funding requirements, include 2 CFR 200. The City requires the final plan to be completed by October 30, 2026.

    Background

    On December 21, 2024, the American Relief Act, 2025, P.L. 118-158, (“the Act”) became law. The funding for the Environmental Protection Agency (EPA) in Title VII of the Act  is available only to states or territories in EPA Regions 3, 4, and 9 for wastewater treatment works and drinking water facilities impacted by Hurricanes Helene and Milton and the Hawai’i wildfires. Florida is eligible to apply for these CWSRF (Clean Water ie Wastewater) and DWSRF (Drinking Water) supplemental funds. States will administer the funds through existing SRF (State Revolving Fund) programs. SRF requirements and procedures apply to these supplemental funds.

    Potential projects were identified through a Request for Inclusion (RFI) submittal process. Final project eligibility will be determined once the Facilities Plan is received and reviewed. Projects that are determined not to meet the Supplemental Agreement – Helene  and Milton (SAHM) eligibility requirement will not be funded beyond the planning phase.  With the initial RFI submittal, the City was awarded $35,139,169 in a capitalization, principal-forgiveness loan through FDEP SRF for drinking water improvements.

      represents that:

    • Drug-Free Workplace Certification (required)

      Preference shall be given to businesses with drug-free workplace programs. Pursuant to Section 287.087, Florida Statutes, whenever two or more competitive solicitations that are equal with respect to price, quality, and service are received by the State or by any political subdivision for the procurement of commodities or contractual services, a response received from a business that certifies that it has implemented a drug-free workplace program shall be given preference in the award process. Established procedures for processing tie responses will be followed if none of the tied providers has a drug free workplace program. In order to have a drug-free workplace program, a business shall:

      1. Publish a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance is prohibited in the workplace and specifying the actions that will be taken against employees for violations of such prohibition.
      2. Inform employees about the dangers of drug abuse in the workplace, the business's policy of maintaining a drug-free workplace, any available drug counseling, rehabilitation, and employee assistance programs, and the penalties that may be imposed upon employees for drug abuse violations.
      3. Give each employee engaged in providing the commodities or contractual services that are under proposal a copy of the statement specified in Subsection (1).
      4. In the statement specified in Subsection (1), notify the employees that, as a condition of working on the commodities or contractual services that are under proposal, the employee will abide by the terms of the statement and will notify the employer of any conviction of, or plea of guilty or nolo contendere to, any violation of Chapter 894, Florida Statutes, or of any controlled substance law of the United States or any state, for a violation occurring in the workplace no later than five (5) days after such conviction.
      5. Impose a sanction on any employee who is so convicted or require the satisfactory participation in a drug abuse assistance or rehabilitation program as such is available in the employee's community.
      6. Make a good faith effort to continue to maintain a drug-free workplace through implementation of applicable laws, rules and regulations.

    Q (Public Safety BDA or Cellular DAS): Will this facility require a Public Safety BDA or Cellular DAS?

    A: Not at this time.


    Q (City’s SRF RFI to FDEP Requested to Clarify Facility Plan Scope): Can the City share the SRF Request for Inclusion (RFI) that was submitted to FDEP for the SAHM funding?  This will better define the scope of the Facility Plan and provide understanding of the specific aspects of the City’s system that must be included in the Facility Plan.

    Q (Timeline): Does the City have a proposed project schedule to complete the Facility Plan?  The timeline in the RFQ states that the award will be at the end of June, which leaves only four months to prepare the Facility Plan, which is due to FDEP by October 30, 2026.  The requirements for an SRF Facility Plan are quite extensive, and there are also additional requirements related to resiliency components for the SAHM funding. It may be challenging to prepare a comprehensive Facility Plan in 4 months, given all these requirements. Has the City considered using a firm from the Engineering Library to do this work to start sooner and have more time to prepare the comprehensive Facility Plan?

    A: The City has considered using the Engineering Library but at this time we are moving forward with the RFQ for selection of a consulting firm.


    Q (No subject): Would the City consider the following changes to Article 5.29, Royalties and Patents, of the Request for Qualifications? If infringement of intellectual property occurs as part of the Offeror’s professional services, the Offeror would be unable to defend a claim under its professional liability insurance. Also, defense of the City would not be allowed under FS 725.08. The City recently agreed to the following language via Addendum for RFQ 26-013MK. "The Offeror shall pay royalties and license fees for equipment, processes, or materials necessary to perform its services. Pursuant to Section 725.08, Florida Statutes, the offeror shall indemnify and hold harmless the City and its officers and employees from liabilities, damages, losses, and costs, including reasonable attorneys’ fees, to the extent caused by the negligence, recklessness, or intentionally wrongful conduct of the Offeror or its personnel related to claims of infringement of patent, trademark, or copyright as part of the professionals services under this agreement."
