Special Notice of Intent to Award Sole Source:
**Note: Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made. No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.”
Project Title: FOD Mats
The 97th Contracting Flight, Altus AFB, hereby submits an intent to award a sole source notice. The Government intends to award a firm-fixed-priced contract to Spartan Composites LLC under FAR 13.106-1(b) for FOD Mats at Ebbing Air National Guard Base. This procurement action is being conducted in accordance with FAR 13.106(b)(1)(i), Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available.
An extended description of the product being acquired is as follows:
• 7'x12' HMWPE Trackout Control Mat
• 10-Round Head Stakes per pack
• 5450 6" FODS Screw
• FODS Cleaning Shovel
• Mat Moving Tool
*This notice does not constitute a solicitation document. Requests for such documents will not be considered. However, all information received after publication of this notice will be considered SOLELY for the purpose of determining whether to conduct competitive procurement in the future. A determination by the Government not to open the requirement to competition based upon responses to this notice is solely within the discretion of the Government. Information received will be evaluated as to confirm or deny the decision to conduct competitive procurement. The Government will not be responsible for any costs incurred by responding to this notice. The Government will not pay for information received. Firms who desire to challenge this sole source action must submit an interest letter (email is acceptable) that demonstrates technical expertise, certifications, and authorization to compete for this acquisition. The letter must describe clear and convincing evidence that competition would be advantageous to the Government and will not be cost or time prohibitive.*
FOD Mats are a proprietary design and protected by a US issued patent on behalf of Spartan Composites LLC. This design offers a unique manipulation of vehicle tires by the pyramid structures to release trapped mud/debris/FOD from the tires upon contact with the mats. This manipulation of the tire tread is a passive capability and unique to FOD Mats. Market research was conducted and has confirmed that the above company is able to meet the government's needs. Accordingly, a sole source award will be made to Spartan Composites LLC.
