    Notice of Intent to Sole Source THIS IS A NOTICE OF INTENT TO AWARD A SOLE-SOURCE CONTRACT AND IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. The U.S. Army Medical Research Acquisition Activity (USAMRAA) in support of the Defense Health Agency Western Contracting Division, intends to issue a Firm-Fixed Price (FFP), Sole Source Award to Medtronic USA Inc., 710 Medtronic Parkway, Minneapolis Minnesota, 55432, which will provide the services, materials and equipment necessary for the repair/preventative maintenance of the Medtronic ENT Intracranial Stereotactic system and Neurological physiological monitor located at the Naval Hospital Operating Room in Bremerton, WA. In accordance with FAR 13.106-1(b)(1)(i), “The Contracting Officer may solicit from one source of the contracting officer determines that the circumstances of the contract action deem only one source reasonably available”. In this instance, Medtronic is the sole manufacturer and distributor of the aforementioned equipment, and as such is the only authorized company to maintain/repair said equipment. These Medtronic products are complex medical devices subject to regulation by the Food and Drug Administration. As such, Medtronic does not authorize the repair or service of these Medtronic Products by customers or third parties, including the loading or reloading of software, and does not authorize any third parties to perform service or repair. Medtronic cannot guarantee the proper performance or results of its systems following any unauthorized service, repair or modification to these Medtronic Products, and any unauthorized service, repair or modification will void existing warranties and service agreements. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE QUOTES and a written solicitation will not be issued. This announcement constitutes the only notice by the Government; however any interested business that believes it can meet the requirement must respond in writing in the form of a capability statement. Responses must include supporting evidence that is clear and concise which articulates the ability to comply with the requirement outlined above. A request for documentation will not be considered an affirmative response. Information received will be considered solely for the purpose to determine whether a competitive procurement is in the best interest of the Government. A determination by the Government not to compete this procurement on a full and open competitive basis will be made based on the responses received. Determination is solely within the discretion of the Government. If no written responses are received by the date listed below, which reflects fifteen (15) days after the publication of this notice, the proposed contract will be awarded without further remark.
