    Q (Partnership Requirements for Special Inspections and Testing Services Submission): As a firm specializing in special inspections, materials testing, and geotechnical engineering, do we need to partner with a construction management firm in order to submit our qualifications for this RFQ?

    A: Yes. The City intends to award a single, comprehensive contract through this RFQ, so firms providing the outlined services would need to partner with a construction management firm to submit a complete set of qualifications.


    Q (Section Dividers Counted? ): The RFQ limits the main proposal body to 10 pages, with resumes and exceptions attachments excluded from this limit. Please clarify whether section separator pages—such as those marking transitions between sections (e.g., between Section 2 and Section 3, or Section 3 and Section 4) that include only the project title, section number, and serve as section dividers—are counted toward the 10-page limit.

    A: Divider sheets do not count towards the 10-page limit.

    Q (DBE Requirements – Contradictory Statements): Page 4 states: "In accordance with the Interim Final Rule (IFR) published by the US Department of Transportation on September 30, 2025, this solicitation is not subject to DBE requirements." Page 7 and Page 8 state: "Ensure compliance with Contractor's DBE requirements" and "Ensure that the contractor complies with the DBE Program Plan," with a note that this is "optional if DBE requirements are required at the time of the construction solicitation." Conflict: The RFQ inconsistently presents DBE compliance as both not applicable to this solicitation and as a potential ongoing obligation. Please clarify whether DBE monitoring will be required under the master agreements or under individual task orders, and how this aligns with the IFR.

    A: In accordance with the IFR issued by the U.S. Department of Transportation on September 30, 2025, DBE requirements do not apply to this RFQ or the resulting master agreement. However, contractor DBE monitoring may be required under individual task orders if DBE requirements are reinstated at the time a construction project is advertised.


    Q (RE Vs CM ): Regarding the RFQ’s scope and federal funding requirements, please clarify the conflict between Section 3.3, which mandates the Resident Engineer be a licensed professional civil engineer, and Section 3.11, which requires the Construction Manager to also serve as Resident Engineer but does not explicitly require that individual to hold a California civil engineer license—does the City intend both roles to require a licensed PE for all federally funded projects?

    A: Correct. The Resident Engineer must be a registered Civil Engineer in the State of California. While the City requires that at least one member of the Construction Management team hold a professional engineering license, not all team members are required to be licensed.
