1. Service Provider shall provide As-Needed Railroad Inspection and Maintenance Services at the San Diego Unified Port District (District) National City Marine Terminal and Tenth Avenue Marine Terminal.2. Limitation of ServicesThe services under this Agreement are intended to be limited to inspection and routine railroad maintenance activities only.No construction, capital improvements, reconstruction, or other activities that would constitute public works under California Labor Code Section 1720 shall be performed under this Agreement.Work authorized under Task Authorizations shall be limited to routine maintenance, inspection activities, and minor repairs necessary to maintain safe operation of existing railroad infrastructure. Work shall not include construction, reconstruction, capital improvements, or replacement of major railroad infrastructure components.3.
