    NOTICE IS HEREBY GIVEN that the CITY OF TUSTIN, as AGENCY invites sealed bids for the construction, materials, supplies, equipment and/or services set forth herein, subject to all conditions outlined in the Bid Package.

    Scope of Work: The project includes renovation of existing planting areas and installation of five sculptural concrete pedestals within the Linear Park at Tustin Legacy. Work consists of clearing and grubbing, weed abatement, drill seeding with a weed-suppression mix, soil amendments, and new planting in designated areas. The contractor shall repair and adjust the existing irrigation system and perform an irrigation coverage test prior to final acceptance.

      The City has made every effort to make all aspects of the vendor registration and bidding process as easy, secure and reliable as possible. In order to mitigate any last minute unforeseen technical issues with on-line/electronic bid submissions, we recommend that bidders submit their bid/proposal as early as possible.       The bidder as represented in the electronic submission of the foregoing bid agrees that the bid is not made in the interest of, or on the behalf of, any undisclosed person, partnership, company, association, organization, or corporation; that the bid is genuine and not collusive or sham; that the bidder has not directly or indirectly induced or solicited any other bidder to put in a false or sham bid, and has not directly or indirectly colluded, conspired, connived, or agreed with any bidder or anyone else to put in a sham bid, or that anyone shall refrain from bidding; that the bidder has not in any manner, directly or indirectly, sought by agreement, communication, or conference with anyone to fix the bid price, or that of any other bidder, or to secure any advantage against the public body awarding the contract of anyone interested in the proposed contract; that all statements contained in the bid are true; and, further, that the bidder has not, directly or indirectly, submitted his or her bid price or any breakdown thereof, or the contents thereof, or divulged information or data relative thereto, or paid, and will not pay fee to any corporation, partnership, company association, organization, bid depository, or to any member or agent thereof to effectuate a collusive or sham bid.

      The undersigned hereby promises and agrees that in the performance of the work specified in the project contract, known as the Legacy Park Improvements, CIP 20094, (I)(we)(it) will employ and utilize only qualified persons, as hereinafter defined, to work in proximity to any electrical secondary or transmission facilities or any gas or fuel lines. The term "Qualified Person" is defined in Title 8, California Administrative Code, Section 2700, as follows:

      Qualified Person: “A person who, by reason of experience or instruction, is familiar with the operation to be performed and the hazards involved."

      The undersigned also promises and agrees that all such work shall be performed in accordance with all applicable utility company's requirements, Public Utility Commission orders, and State of California Cal-OSHA requirements.

      The undersigned further promises and agrees that the provisions herein shall be and are binding upon any subcontractor or subcontractors that may be retained or employed by the undersigned, and that the undersigned shall take steps as are necessary to assure compliance by any said subcontractor or subcontractors with the requirements contained herein.
