Introduction
Beaufort County recognizes that the South Carolina General Assembly, in South Carolina Code of Laws Section 11-35-5210*, has declared that businesses owned and operated by minority persons have been historically restricted from full participation in our free enterprise system to a degree disproportionate to other businesses; and that it is in the state’s best interest to assist minority-owned businesses to develop fully as a part of the state’s policies and programs which are designed to promote balanced economic and community growth throughout the state. Therefore, Beaufort County wishes to ensure that those businesses owned and operated by minorities are afforded the opportunity to fully participate in its overall procurement process for goods and services. Further, Beaufort County seeks to ensure that small businesses are likewise afforded the same participation opportunity as minority businesses. Consequently, attention of all bidders and proposers is called to contract conditions contained herein pertaining to Beaufort County’s “Small and Minority Business Participation Program”, as prescribed in the Beaufort County Code of Ordinances Section 2-537.2.
Definitions
Small Business means a for-profit concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on government contracts, and qualified as a small business under the criteria and size standards in the Code of Federal Regulations, Title 13, Part 121, as amended. Beaufort County refers to these businesses as Small Business Enterprises or “SBE”.
Minority Business means a concern at least fifty-one percent (51%) owned by a person determined to be socially and economically disadvantaged. Socially disadvantaged means those persons who have been subject to racial or ethnic prejudice or cultural bias because of their identification as members of a certain group without regard to their individual qualities. Such groups include, but are not limited to, Black Americans, Hispanic Americans, Native Americans (including American Indians, Eskimos, Aleuts and Native Hawaiians), Asian Pacific Americans, women and other minorities to be designated by the Beaufort County Council. Economically disadvantaged means those socially disadvantaged persons whose ability to compete in the free enterprise system has been impaired due to diminished capital and credit opportunities as compared to others in the same business area that are not socially disadvantaged. Beaufort County refers to minority businesses as Minority Business Enterprises or “MBE”.
Small and Minority Business Enterprises will be abbreviated as “S/MBE”.
Provisions
The successful bidder or proposer, hereafter referred to as “Contractor”, is required to (1) make specific Pre-Award “Good Faith Efforts” to recruit S/MBE and (2) Post-Award “Compliance Efforts” of its labors to utilize S/MBE, unless self-performing one hundred percent (100%) of the contract work. Falsification of any pre-award or post-award documents will be considered a serious breach of public trust and funds.

1.3 Comprehensive Automobile Liability Insurance – The Contractor shall have and maintain, during the life of this contract, Comprehensive Automobile Liability, including non-owned and hired vehicles, of at least $500,000 COMBINED SINGLE LIMIT.
1.3.1 ADDITIONAL INSURANCE REQUIREMENTS: Umbrella Liability Insurance – Contractor shall have and maintain, during the life of this contract, Umbrella Liability Insurance with a minimum limit of $2,000,000
1.3.2 Builders Risk/Instillation (For Construction Projects Only) Contractor is to provide Builders Risk/Instillation coverage at finished replacement cost value. The coverage is to include building materials in transit or at the job site location.
1.3.3 Professional Liability (Errors & Omissions): (For Professional Services Only) Professional Liability Insurance protects against losses that occur when a “professional” errors in judgement, planning, and design could result in economic loss to the entity or county. In order to determine if Professional Liability should be required ask yourself: Is the professional licensed or certified (i.e. architects, consultants, auditors, attorneys, engineers, etc.)? Required if a contractor is performing any type of design/build for a particular project.

It is the intent of Beaufort County to solicit competitive bids from SCDOT pre-qualified contractors to provide materials and construction services for the Beaufort County Sunset Boulevard (S-186) & Miller Drive West (S-187) Project. The project will involve grading, milling, full depth patching, asphalt paving, pavement markings, asphalt sidewalk installation, sign installation, sediment and erosion control, traffic control, and other items.
This project is part of the 2018 Sales Tax Program and is governed by an Intergovernmental agreement between SCDOT and Beaufort County and an SCDOT encroachment permit.
All work shall be completed in accordance with applicable SCDOT Standard Drawings, Standard Specifications, latest edition and Supplemental Technical Specifications as well as the SCDOT ‘Policy for Accommodating Utilities on Highway Right-of-Way’ and DOT’s ADA Guidelines for Transportation Facilities.
All materials used on the project shall conform to the SCDOT Qualified Products List. All certifications and submittals shall be submitted to the County’s designated Project Engineer prior to beginning work.
Beaufort County and SCDOT shall be notified at least 48 hours prior to beginning work.
Any change orders or change in directives shall be agreed upon in writing for scope, time, pay items, quantities and prices prior to commencement of work. Any work performed outside of the contract, not directed by county, and/or not agreed upon and approved in writing prior to commencement of work will not be paid. Any field changes or plan revisions must be approved by SCDOT.
Bid quantities are approximate. Bidders are responsible for verifying all quantities of work including full depth patching. Any quantities exceeding the contract amount shall be requested in writing prior to the work being performed.
The Contractor shall be responsible for the protection of traffic at all times during construction. Traffic control devices, signs, flaggers, etc. shall be provided by the Contractor in accordance with SCDOT Standard Drawings, Standard Specifications, the MUTCD, and the plans. A traffic control plan must be submitted for approval a minimum of two weeks prior to beginning work for review and approval. A certified traffic control supervisor must be on-site during traffic control operations.
Standard Erosion Prevention and Sediment Control practices must be routinely checked and maintained throughout the project and should be dynamically adjusted according to changing weather and site conditions.
A progress schedule with beginning and completion dates for all phases of construction must be submitted a minimum of two weeks prior to commencement of work for approval.
Advance public notifications for resurfacing activities and lane closures must be provided at least one week prior to resurfacing operations. Flyers shall be distributed to adjacent property owners and businesses at least 48 hours prior to resurfacing. Media notice a minimum of two weeks prior to any road closures will be required.
One road closure for up to seven (7) days is allowed for the construction of the raised intersection at Sunset Boulevard and Miller Drive West. Access to adjacent driveways must be maintained.
Contractor to provide Independent third-party SCDOT Certified Level 1 Inspections to include:
· Set up roller patterns, monitor asphalt placement, verify temperature and receive load tickets.
· Document all work and inspections in accordance with SCDOT procedures. Provide weekly copies of reports to County’s Project Manager.
· Provide independent SDOT Certified inspector at the asphalt plant during batching operations to monitor and document product and tests in accordance with SCDOT requirements. Third party Quality Assurance (QA) observations will be administered by the County’s representative.
As-built drawings must be provided within 30 days of final inspection.

Liquidated Damages in the amount of $800 per day will be assessed for failure to re-open the intersection of Sunset Boulevard and Miller Drive West after 7 days.
Clarifications
Asphalt adjustment indexing using the SCDOT Index will be utilized for this project.
A County-provided, digital rain gauge will be installed on the project as the site rain gauge, for monthly values. If a day’s rainfall amount exceeds 0.1 inch it will be deemed a rain day. If the total number of rain days exceeds the 20-year average, the difference will be added to the contract. No additional weather days will be given for any reason with the exception of declared emergencies.
Coordination with utility providers for relocation of facilities located within the project that
interfere and/or impact construction is the responsibility of the Contractor.
Contractor shall be responsible for maintenance of the roadway after Notice to Proceed is issued until Final Acceptance. All work shall be performed in a clean, properly organized, workman-like manner. Contractor shall make adequate provisions for maintaining proper drainage. Reasonable access to private driveways must be maintained.
Contractor shall monitor weather reports to avoid open cut trenching in advance of inclement weather to avoid damage to completed work or existing facilities for public use. There shall be no trench left open within the roadway when work Is not in progress.
Restoration of pavement, shoulders, ditches, etc. to be completed as soon as possible. Areas of disturbance/disruption cannot exceed 2,000 linear feet at any given time.
Time between milling of the roadway and asphalt paving will not exceed 5 calendar days.
The entire width of the road shall be resurfaced as shown on the plan set.
It is the responsibility of the Contractor, in the presence of the County’s representative, to mark all full depth patch locations. The County’s representative must be present to review and verify field marked full depth patch areas.
For paving during the months of December, January and February, a Cold Weather Paving Plan must be submitted to the County Project Manager for approval prior to paving operations.
Past experience has shown with careful planning daytime work may be successfully performed on high volume roads. HOWEVER, the owner reserves the prerogative to require NIGHTTIME work on US 21 and SC 802 based on prevailing traffic conditions, contractor performance, etc. No additional payment will be made if it is determined that nighttime work is in the best interest of the public. Nighttime work for the tie-ins on US 21 and SC 802 may be required by the SCDOT encroachment permit.
Prior to beginning the work, inventory all roads for existing pavement markings and RPM locations, including blue hydrant location markers. All crossline pipes should be located and flagged.
Thermoplastic pavement markings and RPMs shall be completed within 30 days of completion of the road resurfacing.
In the event of a hurricane evacuation, either voluntary or mandated, all operations shall cease and all equipment shall be removed from the SCDOT right of way. Work may resume after the State Government has given the all-clear to return and notice to resume work is given by Beaufort County.
The successful Contractor is required to fulfill any Small and Minority Business Enterprise (S/MBE) commitments made in conjunction with the “Pre-Award Good Faith Efforts”, unless good cause is demonstrated for any failure to fulfill such commitment.
If the Contractor intends to make any substitutions for any reasons, the Beaufort County Compliance Office must be notified in writing within ten (10) business days for discussion and approval. No Contractor shall enter into an agreement with any S/MBE that would in any manner limit the S/MBE from selling or acting as a subcontractor to any other party.
Beaufort County shall have the right to inspect the Contractor’s records related to activity and expenditures to S/MBE utilized on its projects, to include related contracts/purchase orders and payment records, such as cancelled check copies. Further, designated Beaufort County personnel are permitted access to all work sites. Contractors and their staff should take measures to cooperate fully with all Beaufort County staff, including, but not limited to the Procurement Services Director and Compliance Officer.
“Post-Award Compliance Efforts” require the Contractor to not only provide monthly reports regarding activity and expenditures to S/MBE, but also to maintain related records throughout the life of the project regarding its efforts to comply with the Small and Minority Business Participation Program. The “Monthly Compliance Status Report” must be submitted to the Compliance Office until the project ends, by the fifth (5th) day, reflecting the activity of the previous month.
After the County receives a monthly status report marked as “final”, the Contractor will be issued an affidavit to certify totals regarding S/MBE usage throughout the life of the project.
