Businesses facing listing are given a preliminary warning and an opportunity to resolve their liabilities before facing full suspension from contract eligibility. In effective terms, they have 20 days from receiving notice of their impending placement on The WALL to either settle their outstanding fines or contest their placement on the list. This proactive approach is designed to deter labor exploitation and bolster the interests of compliant businesses, preventing them from being undercut by those who exploit workers and evade responsibilities.
The NJDOL’s initiative operates under bipartisan legislation (S-4226), introduced in 2020, designed to tackle issues such as worker misclassification and unfair labor practices.
