    Special no-interest cases are limited

    If advance payments will be made without interest, the findings must include one of the specific justifications allowed by the section: nonprofit educational or research work, management and operation of a Government-owned plant, or other unusual facts and circumstances that favor no-interest advance payments.

    Authorization must cite authority and terms

    The authorization must state the amount or ceiling, the legal authority for the advance payments, and the terms under which they are made. If prior advance payment authorizations exist for the same contract, the new authorization should supersede them.

    Responsibilities

    Contracting Officer

    Prepare individualized written findings, make the determination, and issue the authorization. The contracting officer must ensure the record supports the need for advance payments, the adequacy of security, the correct interest treatment, the proper statutory authority, and any supersession of prior authorizations.

    Contractor

    Demonstrate the need for advance financing, provide the facts supporting the request, and comply with the proposed advance payment clause, including special account requirements, lien protections, and any bond or financial management controls required for Government protection.

    Agency/Approving Official

    Review and approve the findings, determination, and authorization as required by agency procedures and ensure the advance payment decision is legally supportable, properly documented, and consistent with the applicable financing authority.

    Financial Institution or Surety, if applicable

    Support the security structure required by the advance payment clause, such as maintaining the special account or providing bond protection that helps secure the Government’s interest.

    (a) Each determination concerning advance payments shall be supported by written findings (see 32.402 (c)(1)(iii)). (b) The following is an example of the format and text of findings, determination, and authorization with alternative words, phrases, and paragraphs to be selected to conform to the circumstances involved: Findings, Determination, and Authorization for Advance Payments Findings (a) The undersigned hereby finds that: (1) The ________________ [ Insert the name of the contracting activity ] and ________________ [ Insert the name of the contractor ] (have entered) (propose to enter) into (negotiated) (sealed bid) Contract No., dated . [ Summarize the specific facts and significant circumstances concerning the contract and the contractor, that, together with the other findings, will clearly support the determination below. ] (2) Advance payments (in an amount not to exceed $__ at any time outstanding) (in an aggregate amount not exceeding $________, less the aggregate amounts repaid, or withdrawn by the Government) are required by the Contractor to perform under the contract. The amount does not exceed the unpaid contract price or the estimated interim cash needs arising during the reimbursement cycle.
