FAR 52.236-26—Preconstruction Conference.
Plain-English Summary
FAR 52.236-26, Preconstruction Conference, is a simple but important clause used in construction contracting to establish whether the Government will hold a preconstruction meeting before work begins. The clause covers the Contracting Officer’s discretion to decide whether to conduct the conference, the requirement to notify the successful offeror if a conference will be held, the successful offeror’s obligation to attend, and the contents of the Government’s notice, including the date, time, location, whether subcontractors must attend, and the topics to be discussed. In practice, this clause is a coordination tool: it helps align the contractor and Government on administrative, technical, safety, scheduling, site access, submittals, quality control, and other project-start issues before field work starts. It does not itself create detailed meeting procedures, but it ensures the parties know that a formal kickoff meeting may be required and that attendance is mandatory once the Contracting Officer elects to hold it. For contractors, the clause signals that mobilization planning should include readiness for a Government-led conference and possible subcontractor participation. For contracting officers, it provides a straightforward mechanism to set expectations early and reduce misunderstandings at the start of performance.
Key Rules
Conference is discretionary
The Contracting Officer decides whether to conduct a preconstruction conference. The clause does not require a meeting in every contract; it only applies if the Government chooses to hold one.
Successful offeror must attend
If the Contracting Officer decides to hold the conference, the successful offeror will be notified and is required to attend. Attendance is not optional once notice is given.
Notice must be specific
The Government’s notification must state the date, time, and location of the conference. This gives the contractor clear logistical information and avoids ambiguity about when and where attendance is required.
Subcontractor attendance may be required
The notice must identify any need for subcontractor attendance. This allows the Government to require participation by key subcontractors when their roles are important to startup coordination.
Discussion topics must be identified
The notification must include the items to be discussed. This helps the contractor prepare the right personnel and information for the meeting and supports an efficient kickoff.
Responsibilities
Contracting Officer
Decide whether to hold a preconstruction conference; if one will be held, notify the successful offeror; provide the date, time, and location; identify whether subcontractors must attend; and specify the items to be discussed.
Successful Offeror / Contractor
Attend the preconstruction conference when notified that one will be held; ensure the appropriate company representatives are available; and, if required by the notice, arrange for relevant subcontractors to attend.
Subcontractors
Attend the conference if the notice requires their presence and be prepared to discuss their scope, coordination needs, and any issues relevant to project startup.
Agency / Project Team
Support the Contracting Officer in preparing meaningful conference topics and coordinating project-start information so the meeting addresses practical execution issues.
Practical Implications
This clause is mainly about early coordination, so contractors should treat the notice as a mandatory project-start event, not a courtesy invitation.
A common pitfall is failing to send the right people; the notice may require subcontractor attendance, and the contractor should ensure decision-makers and technical staff are present.
The clause can help prevent startup problems by surfacing issues such as site access, submittals, safety, quality control, schedule milestones, and communication channels before work begins.
Contracting officers should make the notice clear and complete, because vague meeting details can lead to confusion, poor attendance, or missed preparation.
Even though the clause is short, it can have real schedule impact: contractors should plan mobilization with the possibility that work may not proceed smoothly until the conference is completed and expectations are aligned.
Official Regulatory Text
