FAR 52.252-1Solicitation Provisions Incorporated by Reference.

    Plain-English Summary

FAR 52.252-1 tells offerors that a solicitation may incorporate one or more solicitation provisions by reference instead of printing the full text in the solicitation. It explains that those incorporated provisions have the same force and effect as if they were included in full, and that the contracting officer must provide the full text on request. The clause also warns offerors that some incorporated provisions contain blocks or blanks that must be completed and returned with the quotation or offer, and it allows the offeror to satisfy those requirements by identifying the provision and supplying the required information rather than reproducing the entire provision. Finally, it addresses electronic access by allowing the solicitation to list Internet addresses where the full text of the incorporated provisions can be found. In practice, this provision is about notice, accessibility, and administrative efficiency: it lets agencies keep solicitations shorter while still binding offerors to the incorporated terms, and it puts the burden on offerors to locate, understand, and complete any required provision data before submitting a responsive offer.

    Key Rules

    Incorporation has full force

Provisions incorporated by reference are legally part of the solicitation exactly as if they were printed in full. Offerors cannot ignore them simply because the text is not reproduced in the solicitation package.

    Full text available on request

The contracting officer must make the full text of incorporated provisions available when requested. This ensures offerors have a fair opportunity to review the actual language before submitting a quotation or offer.

    Offerors must complete required blocks

Some incorporated provisions include blanks, checkboxes, or other blocks that must be filled in by the offeror. The clause warns offerors to identify and complete those required elements as part of their submission.

    Alternative to full reproduction

Instead of submitting the entire text of an incorporated provision, the offeror may identify the provision by paragraph identifier and provide the required information with its quotation or offer. This is a convenience rule, not a waiver of the underlying requirement.

    Electronic access may be provided

The solicitation may list one or more Internet addresses where the full text of incorporated provisions can be accessed electronically. If electronic access is provided, offerors are expected to use it to review the incorporated terms.

    Responsibilities

    Contracting Officer

Include the clause when solicitation provisions are incorporated by reference; make the full text of incorporated provisions available upon request; and, when used, provide accurate Internet addresses for electronic access to the provisions.

    Offeror

Review all incorporated provisions, obtain the full text if needed, complete any required blocks or information, and submit the required data with the quotation or offer. The offeror must not assume that omitted text means omitted obligations.

    Agency

Maintain solicitation practices that allow incorporated provisions to be accessible and understandable, including supporting electronic posting or retrieval where used.

    Practical Implications

    1

This clause reduces solicitation length, but it increases the need for careful review because important requirements may be hidden in referenced provisions rather than visible in the main document.

    2

A common pitfall is failing to notice that an incorporated provision contains a required fill-in block, certification, or selection that must be returned with the offer.

    3

Offerors should verify every referenced provision and not rely on memory or prior solicitations, because the exact text and required responses can change.

    4

Contracting officers should ensure the solicitation clearly identifies incorporated provisions and provides a reliable way to obtain the full text, especially when using electronic links.

    5

If an offeror misses a required entry in an incorporated provision, the submission may be nonresponsive or otherwise unacceptable depending on the provision and procurement context.

    Official Regulatory Text

As prescribed in 52.107 (a) , insert the following provision: Solicitation Provisions Incorporated by Reference (Feb 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. Also, the full text of a solicitation provision may be accessed electronically at this/these address(es): _____________________________________________ _____________________________________________ _____________________________________________ [ Insert one or more Internet addresses ] (End of provision)
